We are living in a drastically different world from that of out forefathers we have technology today that goes way beyond anything they probably ever thought possible. In fact they would have probably burned us at the stake. This country was founded on ideas coming from a people who were tired of being told how to live, what to think and who was allowed to do what. They wanted freedom of thought along with many other things. After being taxed by the British without any representation basically we had some issues. It’s a bit tricky really the American colonists were being taxed because of laws causing a monopoly on tea trade with the East India Company. The monopoly led to people smuggling tea from other places and the company began to lose money. They then began taxing the colonies. The colonists did not feel this was right causing protests. After one of the ship carrying tea was rejected and told they couldn’t return the tea protester threw it into the harbor rather then let it go. Long story short British soldiers came shot people and we told England to love off. None as the The Boston Massacre I feel this is where the war really began.

Later we became our own country with are own ideas much of our country is based off of English law but with our own twists. The reason I am writing this is to discus mainly the 2nd Amendment. “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”. It wasn’t added for shits and giggles does it hold any purpose now who’s to say. Many places had laws set up telling men to own weapons incase there was a need. America was no different but one major reason this was added to the constitution was because they knew at some point the government or even a foreign power may need to be overthrown. Each state of the union has the right to a militia force this is not the National Guard due to the fact militia are apart from government and the National guard is not. The militia is a state based fighting force of civilians where as the National Guard can be called into active duty. Courts have upheld that the right to bear arms is not restricted to the militia but to the people as stated and that the National Guard is not the militia. Now lets look at the words well regulated. Regulate To control or direct according to rule, principle, or law. To me this means one thing the group must function within state laws and uphold the constitution.

Now lately people are freaking out about a nation wide gun ban maybe going to far but I feel with good reason. With Clinton we had an assault rifle ban that didn’t work. Later it was let go and the ban on assault weapons is no more. In recent history the Heller vs. the District of Columbia case led to the Supreme Court returning handguns to D.C. ruling that the 2nd Amendment protects an individual's right to possess a firearm for private use. As some have said it is a god given right to protect yourself but I fear many American’s are now willing to throw away their rights based on falsehoods. Laws banning the use and ownership of guns and other weapons only hurts decent law abiding citizens and turns the into criminals. People seem to believe that outlawing such things will make them instantly disappear from the streets that no gun signs will stop a criminal in his tracks and make them think twice before interring a busyness with a gun. This simply isn’t true. Since the D.C. gun ban violent gun crime rose in most cases gun bans lead to more knife crime. People are violent and this can’t be changed.

Recently I came across a story of a man who open carried a handgun to a movie he was seated in the theater when cops rushed in grabbed him up pulled him outside and took his gun. He violated no law and the court sided with him in the end telling the police to stop harassing people who carry a gun. This whole thing was a violation of his 2nd as well as his 4th Amendment rights but a lot of people wouldn’t even think about it that way. “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized”. We live in an odd time I feel some are saying the constitution is an outdated document and needs to be changed. I heard this from someone I know and it bugged me a bit. Well to end this what are your thoughts?
